An uncontested divorce is the fastest, easiest and most financially attractive option if you are considering a divorce. The prerequisite to an uncontested divorce is an agreement between you and your spouse on all issues relative to your divorce, including debts, assets, and child custody and support.

How to Make an Uncontested Divorce Work in Alabama

Uncontested divorces work best—and work, in general—when you and your spouse can agree on most, if not all, of the financial and personal details that the court would otherwise have to decide, including:

  • Asset Allocation: This includes your house, property and real estate, vehicles, investments, monetary assets, retirement funds and personal property (such as animals, kitchen tools, furniture, i.e.).
  • Child Custody and Financial Support: If children are involved, your spouse and you must be in full agreement regarding physical custody (living and visitation arrangements), legal custody (decisions regarding the legal rights of the child), who pays for health and medical insurance, the amount and frequency of child support paid and who claims the child for income tax purposes.   • Alimony: If alimony is an issue, each spouse must agree to the amount, frequency and length of time that alimony is paid.
  • Debt Allocation: Each spouse must concur on the allocation items specific to marital debt, such as:
  • Automobile and truck loans
  • Other outstanding loans against property
  • Debt specific to medical bills (if children are involved)
  • Mortgages and liens on houses, condominiums, townhomes and other property
  • Student loans
  • Consumer credit card debts

What is Process Like in Alabama for an Uncontested Divorce?

When you work with us, we move your uncontested divorce as quickly as possible through the court system. If both parties are in complete agreement on all issues, we will prepare the documentation for the court and return it to you for your signature. When all documents have been executed, we file the paperwork with the Court. If no objections arise after thirty (30) days, the Alabama courts will declare your divorce final.
